BIG SPRING, TX — Today a jury in the 118th District Court found Quincy Lamar Henry, 35, of Big Spring, TX, guilty of Capital Murder and Aggravated Assault with a Deadly Weapon, both first-degree felonies. Originally a second-degree felony, the Aggravated Assault with a Deadly Weapon charge was enhanced due to Henry’s prior felony conviction.
On November 17, 2022, Henry was in an altercation that resulted in the shooting of Don Brooks and Edward Martinez. Both Brooks and Martinez died from the injuries sustained. A female victim was also injured in the shooting. Erika Nielsen, First Assistant District Attorney for Howard County, told KBest News this was a unique case because there was a living victim who was able to testify about the murders.
According to Howard County District Attorney Josh Hamby, this was a Capital Murder case because there were two deaths that occurred from the same incident. This is automatically punishable with a death sentence or life in prison without the possibility of parole, however, the State decided to abandon seeking the death penalty.
Henry was sentenced to life in prison without the possibility of parole for the Capital Murder and the jury recommended a sentence of 40 years with no fine for Aggravated Assault with a Deadly Weapon. This was the first Capital Murder case to be tried in Howard County since Fall 1995.
The case was prosecuted by Howard County District Attorney Josh Hamby and First Assistant District Attorney Erika Nielsen. Presiding judge during the trial was 118th District Court Judge Shane Seaton.
